튠포스트(TunePost) 이용약관

튠포스트(tunepost.app, 이하 "튠포스트")을 이용해 주셔서 고맙습니다. 이 약관은 튠포스트를 이용할 때 지켜야 할 약속과 서로의 권리를 정합니다. 튠포스트를 이용하시면 이 약관에 동의하신 것으로 봅니다.

1. 운영자

2. 튠포스트가 하는 일

튠포스트는 이용자가 쓴 편지(직접 입력하거나 손편지 사진을 올린 것)를 인공지능(AI)으로 노래로 만들고, 카드와 함께 링크로 보낼 수 있게 해 주는 서비스입니다.

• 가입 없이 이용할 수 있습니다.
• 노래 미리듣기는 무료이고, 노래편지를 완성할 때 요금이 부과됩니다. 요금은 결제 전에 화면에 표시됩니다.
• 완성된 노래편지는 고유한 링크로 받는 분께 전달됩니다. 링크를 가진 사람은 누구나 노래편지를 열어볼 수 있으니, 링크는 받는 분께만 보내 주세요.

3. 이용 나이

• 만 14세 이상만 튠포스트를 이용할 수 있습니다.
• 아이가 쓴 편지는 부모님이나 보호자가 대신 올려 주세요. 이때 올리는 분이 아이의 편지와 이름을 사용하는 데 필요한 동의를 받은 것으로 봅니다.

4. 이용자의 편지와 사진

• 이용자가 올린 편지, 사진, 이름의 권리는 이용자에게 있습니다.
• 이용자는 튠포스트가 노래편지를 만들고, 보관하고, 받는 분께 보여주는 데 필요한 범위에서만 이를 사용하도록 허락합니다. 이 허락은 노래편지가 삭제되면 끝납니다.
• 다른 사람이 쓴 글, 다른 사람의 사진, 다른 사람의 개인정보를 올릴 때는 그 사람의 허락을 받아야 합니다.

5. 만들어진 노래의 이용

• 편지와 가사: 이용자가 쓴 편지와, 그 편지에서 나온 가사는 이용자의 것입니다.
• 완성한 노래편지의 노래: 이용자는 노래를 개인적인 용도로만 쓸 수 있습니다.
  • 할 수 있는 것: 받는 분께 보내기, 가족과 친구에게 공유하기, 내 휴대폰에 저장하기, 개인 SNS에 올리기, 가족 영상이나 사진 앨범에 넣기
  • 할 수 없는 것: 노래 판매, 음원 사이트(멜론, 스포티파이, 유튜브 뮤직 등) 배포, 광고나 홍보물, 수익이 나는 영상이나 방송, 사업장 배경음악, 그 밖에 돈을 벌기 위한 모든 이용
• 미리듣기 노래: 완성하지 않은 노래(미리듣기만 한 곡)는 들어보는 용도로만 쓸 수 있고, 저장하거나 공유할 수 없습니다.
• 노래는 AI가 만들기 때문에 같은 편지로 만들어도 매번 결과가 다르고, 이미 있는 다른 노래와 비슷하게 들릴 수 있습니다. 튠포스트는 노래가 다른 노래와 비슷하지 않다고 보장하지 않습니다.

6. 하면 안 되는 일

다음과 같은 내용은 노래편지로 만들 수 없습니다. 이런 내용이 확인되면 튠포스트는 해당 노래편지를 삭제할 수 있습니다.

• 법을 어기거나, 다른 사람을 괴롭히거나, 혐오나 폭력을 부추기는 내용
• 다른 사람인 척하거나, 받는 분을 속이려는 내용
• 다른 사람의 노래 가사나 글을 허락 없이 그대로 옮긴 내용
• 다른 사람의 개인정보(전화번호, 주소, 주민등록번호 등)
• 튠포스트를 해킹하거나, 자동화 프로그램으로 대량으로 이용하는 행위

문제가 있는 노래편지를 보거나 받으셨다면 링크와 함께 hello@tunepost.app로 알려 주세요. 확인 후 빠르게 조치합니다.

7. 요금, 취소, 환불

• 요금은 노래편지를 완성하는 순간 결제됩니다. 가격은 세금이 포함된 금액이며, 접속한 나라에 따라 원, 파운드, 달러로 표시됩니다.
• 결제는 Stripe의 판매대행 서비스(Onelink)가 맡습니다. 결제 화면에서는 Onelink가 판매자로 표시되고, 결제와 세금 처리, 영수증 발송은 Onelink의 약관을 따릅니다. 튠포스트는 카드번호를 보거나 저장하지 않습니다.
• 노래편지는 디지털 콘텐츠로, 완성하는 즉시 제공됩니다. 그래서 「전자상거래 등에서의 소비자보호에 관한 법률」 제17조 제2항에 따라 완성 후에는 단순 변심으로 인한 청약철회가 제한됩니다. 이 사실은 결제 전에 화면에 안내합니다.
• 다만 다음의 경우에는 다시 만들어 드리거나 전액 환불해 드립니다.
  • 노래가 재생되지 않거나 파일이 손상된 경우
  • 결제는 되었는데 노래편지가 완성되지 않은 경우
  • 그 밖에 튠포스트의 잘못으로 서비스를 제대로 받지 못한 경우
• 환불 요청은 결제일로부터 30일 안에 hello@tunepost.app로 노래편지 링크와 함께 보내 주세요.

8. 보관과 삭제

• 완성된 노래편지(편지 글, 사진, 카드, 노래)는 만든 날로부터 1년 동안 보관되고, 그 뒤 자동으로 삭제됩니다.
• 그 전에도 완성 화면의 삭제 버튼으로 언제든 직접 지울 수 있습니다.
• 노래 파일은 "노래 저장" 버튼으로 내려받아 기간과 관계없이 간직할 수 있습니다.
• 자세한 내용은 개인정보처리방침에서 확인할 수 있습니다.

9. 서비스 변경과 중단

• 튠포스트는 서비스를 더 좋게 만들기 위해 기능을 바꿀 수 있습니다.
• 서비스를 완전히 끝내야 할 때는 최소 30일 전에 튠포스트 홈페이지에 알리고, 이용자가 노래 파일을 내려받을 수 있는 시간을 드립니다.
• 노래를 만드는 외부 AI 회사의 사정으로 노래 만들기가 일시적으로 늦어지거나 멈출 수 있습니다.

10. 책임의 범위

• 튠포스트는 서비스를 안정적으로 제공하기 위해 노력합니다. 다만 천재지변, 외부 회사(호스팅, AI, 결제)의 장애 등 튠포스트가 통제할 수 없는 사유로 생긴 문제에 대해서는 책임지지 않습니다.
• 이용자가 올린 내용이나 링크를 다른 사람과 공유해서 생긴 문제는 이용자에게 책임이 있습니다.
• 이용자가 이 약관을 어기거나(예: 다른 사람의 가사나 사진을 허락 없이 올리기, 노래를 상업적으로 쓰기), 이용자가 올린 내용 때문에 다른 사람이 튠포스트에 권리를 주장하면, 이용자는 그로 인해 튠포스트에 생긴 손해와 비용(합리적인 법률 비용 포함)을 배상해야 합니다.
• 튠포스트의 고의 또는 중대한 과실로 손해가 생긴 경우에는 법에 따라 책임집니다. 그 밖의 경우 튠포스트의 책임은 이용자가 해당 노래편지에 낸 금액을 한도로 합니다.

11. 약관의 변경

• 약관을 바꿀 때는 시행 7일 전에 튠포스트 홈페이지에 알립니다. 이용자에게 불리한 변경은 30일 전에 알립니다.
• 바뀐 약관에 동의하지 않으면 이용을 멈추고 노래편지를 삭제할 수 있습니다.

12. 분쟁 해결

• 문제가 생기면 먼저 hello@tunepost.app로 연락해 주세요. 성실히 답하겠습니다.
• 이 약관은 잉글랜드 및 웨일스 법을 따릅니다. 다만 이용자가 사는 나라의 소비자 보호법이 이용자에게 주는 권리는 그대로 보장됩니다.

TunePost Terms of Service

Thank you for using TunePost (tunepost.app, "TunePost", "we", "us"). These terms set out what you can expect from us and what we expect from you. By using TunePost, you agree to these terms.

1. Who we are

2. What TunePost does

TunePost turns a letter you write (typed, or a photo of a handwritten letter) into a song using artificial intelligence (AI), and lets you send it with a card as a link.

• You don't need an account.
• Song previews are free. You pay when you complete a song letter. The price is shown on screen before you pay.
• A completed song letter is shared through its own link. Anyone who has the link can open it, so please send it only to the person it's meant for.

3. Age

• You must be 14 or older to use TunePost.
• If a child wrote the letter, a parent or guardian should upload it. By doing so, you confirm you have the permission needed to use the child's letter and name.

4. Your letters and photos

• You keep all rights to the letters, photos and names you upload.
• You allow TunePost to use them only as needed to make your song letter, store it, and show it to the people you share it with. This permission ends when the song letter is deleted.
• If you upload someone else's writing, photos or personal information, you must have their permission.

5. Using your song

• Your letter and lyrics. Your letter, and the lyrics that come from it, are yours.
• Songs in completed song letters. You may use the song for personal, non-commercial purposes only.
  • You may: send it to the recipient, share it with family and friends, save it to your phone, post it on your personal social media, and add it to family videos or photo albums.
  • You may not: sell it, release it on streaming or music services (such as Spotify, Apple Music or YouTube Music), use it in ads or promotional material, use it in monetised videos or broadcasts, play it as background music in a business, or use it in any other way to make money.
• Preview songs. Songs you only previewed and did not complete are for listening only. You may not save or share them.
• Songs are made by AI. The same letter can produce a different song each time, and a song may sound similar to existing music. We do not guarantee that a song will not resemble other music.

6. What you must not do

You must not use TunePost to create song letters that:

• break the law, harass anyone, or promote hate or violence;
• impersonate someone or are meant to deceive the recipient;
• copy someone else's song lyrics or writing without permission;
• contain other people's personal details (phone numbers, home addresses, ID numbers and similar).

You also must not attempt to hack TunePost or use automated tools to access it in bulk. We may delete song letters that break these rules.

If you see or receive a song letter that breaks these rules, email the link to hello@tunepost.app and we will review it promptly.

7. Payment, cancellation and refunds

• You are charged when you complete a song letter. Prices include tax and are shown in pounds, US dollars or Korean won depending on where you are.
• Payments are handled by Stripe's reseller service, Onelink. Onelink appears as the seller at checkout, and payment, tax and receipts are covered by Onelink's terms. We never see or store your card number.
• A song letter is digital content that is supplied immediately. Before you pay, we will ask you to agree that delivery starts straight away and that you therefore lose your 14-day right to cancel (UK Consumer Contracts Regulations 2013).
• This does not affect your statutory rights. We will remake your song letter or give you a full refund if:
  • the song does not play or the file is damaged;
  • you were charged but the song letter was not completed; or
  • you otherwise did not receive the service because of our mistake.
• To ask for a refund, email hello@tunepost.app with the song letter link within 30 days of payment.

8. Storage and deletion

• Completed song letters (letter text, photos, card and song) are kept for 1 year from the date they are made, then deleted automatically.
• You can delete a song letter at any time before then using the delete button on the completion screen.
• You can keep the song file forever by using the "Save song" button.

9. Changes to the service

• We may change features to improve TunePost.
• If we ever close TunePost, we will post a notice on our website at least 30 days in advance so you have time to save your songs.
• Song creation may be delayed or temporarily unavailable because of issues at the AI providers we use.

10. Our responsibility to you

• We work hard to keep TunePost running reliably. We are not responsible for problems caused by events outside our reasonable control, such as outages at our hosting, AI or payment providers.
• You are responsible for what you upload and for who you share your links with.
• If you break these terms (for example, by uploading someone else's lyrics or photos without permission, or by using a song commercially), or if someone makes a claim against us because of content you uploaded, you agree to compensate us for the resulting losses and costs, including reasonable legal fees.
• Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Otherwise, our total liability to you for a song letter is limited to the amount you paid for it.

11. Changes to these terms

• We will post changes on our website at least 7 days before they take effect, or 30 days before for changes that are less favourable to you.
• If you don't agree to the new terms, you can stop using TunePost and delete your song letters.

12. Disputes

• If something goes wrong, please email hello@tunepost.app first and we will do our best to sort it out.
• These terms are governed by the laws of England and Wales. If you are a consumer, you keep the protection of the mandatory consumer laws of the country where you live, and you may bring a claim in your local courts.
